This document and any other documents we reference are the backstage pass to understanding how we operate at Tizzo, or what we officially call our Terms of Use (“Terms” for short).
The Terms are a legally binding contract between you and Tizzo.
This contract sets out your rights and responsibilities when you use Tizzo or any of our services provided by Tizzo (we’ll refer to all of these collectively as our “Services”), so please read them carefully. By using any of our Services (even just browsing our website), you’re agreeing to the Terms. If you don’t agree with the Terms, we ask that you do not use our Services.
Our privacy policy is the digital equivalent of wrapping your data in bubble wrap and putting it in a safe. Your information is precious, and we treat it like the treasure it is. By using our Services, you're also agreeing that we can process your information in the ways set out in our Privacy Policy, so please read it here.
Both Tizzo and sellers process customers’ personal information (for example, buyer name, email address, and delivery address) and are therefore considered separate and independent data controllers of buyers’ personal information under UK law. That means that each party is responsible for the personal information it processes in providing the Services. For example, if a seller accidentally discloses a buyer’s name and email address when fulfilling another buyer’s order, the seller, not Tizzo, will be responsible for that unauthorised disclosure.
If, however, you (as a seller) and Tizzo are found to be joint data controllers of buyers’ personal information, and if Tizzo is sued, fined, or otherwise incurs expenses because of something that you did (or failed to do) as a joint data controller of buyer personal information, then you agree to defend and indemnify Tizzo in accordance with our indemnification policy below.
For some activities you will need to create an account with Tizzo to use our Services. Here are a few rules when opening an account with Tizzo:
Sellers are responsible for the accuracy and legality of their product listings.
Sellers must accurately represent the condition, availability, and specifications of their products, ensuring that product descriptions and images truthfully depict the item being sold.
Sellers agree to promptly update listings to reflect any changes in product availability or condition, ensuring transparency for potential buyers.
Buyers agree to pay the listed price for products they purchase, using only authorised payment methods accepted by Tizzo.
Buyers must provide accurate shipping information for successful delivery, including a valid shipping address and contact details.
Buyers are responsible for reviewing product details, including shipping costs and delivery times, before completing a purchase to avoid any misunderstandings or disputes.
In case of disputes between buyers and sellers, users agree to communicate and resolve issues in good faith, attempting to reach a mutually satisfactory resolution.
If necessary, users may request assistance from Tizzo to mediate disputes, providing relevant information and documentation to support their case.
Users agree to abide by the final decision made by Tizzo's dispute resolution team, understanding that it is aimed at promoting fairness and accountability within the marketplace.
Both buyers and sellers are encouraged to leave fair and honest feedback and reviews after transactions, providing constructive criticism and positive feedback where appropriate.
Users agree not to manipulate or falsify feedback or reviews, understanding that such actions undermine the integrity of Tizzo and may result in account termination.
Tizzo reserves the right to remove any feedback or review that is deemed inappropriate or violates our community guidelines.
Content you post on Tizzo belongs solely to you ("Your content"). We do not claim ownership over it, whether it’s shop names, profile pictures, listing photos, descriptions, reviews, comments, videos, or usernames.
Sellers agree not to list products that infringe upon the intellectual property rights of others, including copyrighted material, trademarks, and patents.
When you post Your Content, you give Tizzo (and anyone authorised by Tizzo) permission to use it. This helps us to continue to function and grow. As an example, we may use Your Content to promote your Tizzo shop or our Services.
By posting Your Content, you give Tizzo (and anyone authorized by Tizzo) a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use, display, edit, modify, reproduce, distribute, store, and create derivative works of it. This lets us provide the Services and promote Tizzo, your shop, and other shops and listings.
We respect intellectual property rights and will remove infringing content.
Buyers agree not to use any content or materials from Tizzo for unauthorised purposes, respecting the intellectual property rights of sellers and other users.
Any allegations of intellectual property infringement should be reported to our intellectual property team for review and appropriate action. If content you own is posted without your permission, please notify us immediately via our contact details. We’ll notify you if any action is taken.
Don’t post abusive, threatening, defamatory, obscene, vulgar, or otherwise offensive content. Also, don’t post false or misleading content or use the Services in a fraudulent or deceptive manner.
We provide you with a limited, non-exclusive, non-transferable, and revocable license to use our Services, subject to the Terms and the following restrictions:
When using our Services, you must uphold all laws applicable to your activities. This includes local, federal, and international laws. Make sure to obtain any necessary permits or licenses for your shop and adhere to legal requirements, such as age verification for item delivery where mandated by law. Your actions on the platform should never breach laws, engage in fraud, or violate the rights of Tizzo, its users, or third parties.
It’s your responsibility to settle all fees owed to Tizzo and handle any applicable taxes related to purchases or sales made through our Services, unless stated otherwise. Tizzo will manage the calculation, collection, and remittance of value-added tax (VAT) or sales tax as necessary. Check out our Payments Policy for detailed information on fees, taxes, and accepted payment methods.
Respect the integrity of our Services by refraining from unauthorised actions like crawling, scraping, or attempting to reverse engineer any part of it without our explicit consent. Furthermore, do not disrupt our Services or harm our systems through malicious activities such as distributing viruses or overwhelming our platform with excessive requests.
To streamline communication and reduce our environmental impact, we rely on Electronic Communications for all our correspondance. By using our Services, you agree to receive legal information electronically. This means we will always send you information through email instead of traditional mail.
Items You Purchase. You understand that Tizzo does not manufacture, store, or inspect any of the items sold through our Services. We provide the venue; the items in our marketplaces are produced, listed, and sold directly by independent sellers, so Tizzo cannot and does not make any warranties about their quality, safety, authenticity, or their legality. Any legal claim related to an item you purchase must be brought directly against the seller of the item. You release Tizzo from any claims related to items sold through our Services, including for defective items, misrepresentations by sellers, or items that caused physical injury (like product liability claims).
Content You Access. You may come across materials that you find offensive or inappropriate while using our Services. We make no representations concerning any content posted by users through the Services. Tizzo is not responsible for the accuracy, copyright compliance, legality, or decency of content posted by users that you accessed through the Services. You release us from all liability relating to that content.
People You Interact With. You can use the Services to interact with other individuals, either online or in person. However, you understand that we do not screen users of our Services other than to meet certain compliance and legal obligations, and you release us from all liability relating to your interactions with other users. Please be careful and exercise caution and good judgement in all interactions with others, especially if you are meeting someone in person.
Third-Party Services. Our Services may contain links to third-party websites or services that we don’t own or control (for example, links to Facebook, Twitter and Pinterest). You may also need to use a third party’s product or service in order to use some of our Services (like a compatible mobile device to use our mobile apps). When you access these third-party services, you do so at your own risk. The third parties may require you to accept their own terms of use. Tizzo is not a party to those agreements; they are solely between you and the third party.
